What are some things I could say?

 

The Senate will vote on House Bill 1348 on Monday, March 22.  I strongly oppose this proposed legislation and sincerely hope you will vote to defeat this bill. 

 

The bill was introduced to grant Xcel Energy the ability to raise noise levels emitted from transmission lines in residential areas to exceed the noise produced by I-25 or DIA.  Homeowners who assumed current power line noise would be acceptable, could in the future have industrial-level buzzing right in their backyards. 

 

Yes, the bill has been amended by the House to allow the Public Utilities Commission (PUC) to set "reasonable" noise levels, however, one key fact is missing.  The bill still grants the utilities' request to be protected from potential lawsuits from excessive noise pollution from power lines.  Losses to homeowners statewide could be significant.  This bill should require utilities to compensate homeowners for loss of enjoyment and values to their properties.

 

We must find a way to avoid impacting adjacent properties through proper planning and land use principles.  No other industry in our state has been granted such immunity regarding noise pollution.  Colorado needs reliable electric power, but we should balance that need with property owners' rights.   We should not allow utility companies to change the rules after the game starts, and devalue property without compensation.

 

I urge you to vote "no" on this bill and protect Colorado property owners.  If you don't, then who will?

á       DON'T get into other issues related to power lines – the bill is ONLY about noise levels and discussing any other concerns such as aesthetics would reduce the impact of your comments.

á       DO emphasize that this is a statewide issue, not just a Douglas County issue.  This will affect all homeowners in the state that live near power lines.
