(continued from previous page) Article V to obtain Architectural Review Committee approval. However, the Master Declaration should be consulted for the specific requirements and provisions relating to such review and consideration of proposed improvements (as defined in the Master Declaration) by said Design Review Committee.
Section 3. Procedures:
(a) The Architectural Review Committee shall approve or disapprove all requests for Committee approval within thirty (30) days after the complete submission of all plans, specifications, and other materials and information which the Committee may require in conjunction therewith. All such submissions shall be made either in person to an authorized agent or member of the Architectural Review Committee or by U.S. mail, certified or registered with postage prepaid. In the event that the Architectural Review Committee fails to approve or disapprove any request within thirty (30) days after the complete submission of all plans, specifications, materials and other information with respect thereto, approval shall not be required and this Article shall be deemed to have been fully complied with.
(b ) It is the Declarants desire and intention that applications for Architectural Review Committee approval be submitted and processed, and approval be obtained, prior to submission by an applicant to the Design Review Committee of the Master Association. However, if an application for approval by the Design Review Committee, as provided in the master Declaration, has been approved or disapproved by such entity prior to submission thereof to the Architectural Review Committee, then the applicant therefor shall so advise the Architectural Review Committee and the Architectural Review Committee shall inquire of said Design Review Committee as to what action will or has been taken with respect thereto. However, the Architectural Review Committee is an independent entity constituted for such purposes as provided in this Declaration and, as such, need not consider and shall not be bound by any review, opinions, conclusions, actions, decisions or other matters made or rendered by said Design Review Committee. Approval by the Design Review Committee does not necessarily guarantee approval by the Architectural Review Committee, or vice versa.
Section 4. Vote and Appeal: A majority vote of the Architectural Review Committee is required to approve a request for architectural approval pursuant to this Article, Unless the Committee has designated a representative to act for it, in which case the decision of such representative shall control. In the event a representative acting on behalf of the Architectural Review Committee approves or denies a request for architectural approval, any Owner shall have the right to an appeal of such denial to the full Committee, upon a request therefor submitted (continued next page)
