(continued from previous page) development of the Properties, specifically including without limiting the generality of the foregoing, maintaining business offices, storage areas, construction yards and equipment, Signs, model units, sales offices, information centers, parking areas and lighting facilities. The Declarant shall further have the right, at any time from time to time, to permit one or more of the Participating Builders to exercise any of the rights granted to the Declarant in this Section 4, whether or not the Declarant may also be exercising one or more of such rights.

Section 5. Household Pets: No animals, livestock, birds, poultry or insects, of any kind, shall be raised, bred, kept or boarded in or on the Properties; provided, however, that the Owners of each Lot may keep a reasonable number of dogs, cats, or other domestic animals which are bona fide household pets, so long as such pet(s) are not kept for any commercial purpose, are not kept in such number or in such manner as to create a nuisance to any resident(s) off the Properties, and are kept in conformance with law, this Declaration and the rules and regulations of the Association. The Association shall have, and is hereby given, the right and authority to determine in its sole discretion that dogs, cats or other household pets are being kept for commercial purposes or are being kept in such number or in such manner as to be unreasonable or to create a nuisance to any resident(s) of the Properties, or that an Owner is otherwise in violation of the provisions of this Section 5, and to take such action or actions as it deems reasonably necessary to correct the same. An Owners right to keep household pets shall be coupled with the responsibility to pay for any damage caused by such Owner's pet(s), as well as any costs incurred by the Association as a result of such pets, and any such costs and damages shall be subject to all of the Associations rights with respect to the collection and enforcement of assessments as provided in Article IV hereof.

Section 6. Temporary Structures: No portion of any Residence shall be occupied as living quarters prior to the substantial completion of the construction of the entire Residence as evidenced by issuance of a temporary or final certificate of occupancy ('CO") therefor. Each Residence must be fully completed with the final CO issued within one (1) year following the commencement of work thereon. Subject to Section 4 of this Article IX, no structure of a temporary character, trailer, mobile home, tent, shack, garage, barn or other outbuilding shall he used on any of the Properties at any time as a residence either temporarily or permanently. The work of constructing, altering or remodeling any structure or other improvements shall be prosecuted diligently from the commencement thereof until completion.
