Section 10. "Maintenance Property" shall mean and refer to all property including the improvements thereto owned by the Association for the common use and enjoyment of the Owners, together with all publicly dedicated roads, streets, rights-of-way and easements located within or adjacent to the perimeter boundaries of the Properties which are to be maintained by the Association. The Maintenance Property which is anticipated to he owned by the Association at the time of the commencement of assessments hereunder is described on Exhibit B attached hereto and incorporated herein by this reference.
Section 11. Master Declaration" shall mean and refer to that certain Master Declaraton of Covenants, Conditions, Restrictions and Easements for Castle Pines North, recorded October 22, 1984 in Book 544 at Page 588 in the real property records of Douglas County, Colorado, as the same may be amended or supplemented from time to time.
Section 12. "Member" shall mean and refer to each Owner of a Lot; membership in the Association shall be appurtenant to, and may not be separated from, ownership of a Lot.
Section 13. "Owner shall mean and refer to the record owner, whether one or more persons or entities, of fee simple title to any Lot which is a part of the Properties, including contract sellers, but excluding those having such interest merely as security for the performance of an obligation.
Section 14. Participating Builder" shall mean any Owner other than Declarant who acquires one or more Lots from Declarant for the purpose of constructing a Residence(s) thereon for sale, and who is designated as a Participating Builder by Declarant, in its sole discretion from time to time (including the right to withdraw designation of an Owner as a Participating Builder), by a written instrument duly recorded in the Douglas County, Colorado, land records.
Section 15. "Properties" shall mean and refer to that certain real property described on the attached Exhibit A and such additions thereto as may hereafter be brought within the jurisdiction of the Association.
Section 16. "Residence" shall mean and refer to any single family home located on a Lot (subject to encroachments upon adjacent Property).
ARTICLE II
