COVENANTS AND APPROVAL OF EXTERIOR HOME AND
LANDSCAPING IMPROVEMENTS:

HOA2 is a covenant-protected community, and all changes to the exterior of your house or lot, including landscaping and changes in paint color, must be approved by the Architectural Control Committee/Covenant Control Committee.

  Why have covenants and architectural approvals?      
 

These guidelines have been prepared in order to implement standards and provide direction to homeowners in Castle Pines North Homeowners Association #2 (CPN HOA 2)with landscaping and/or other improvements to their property. The requirements, objectives, standards, and procedures contained within are all intended to establish, maintain, and provide overall continuity throughout the community. Compliance with these residential guidelines and regulations will help preserve the inherent architectural and aesthetic quality of the whole community.

A spirit of cooperation with the Architectural Control Community (ACC) and neighbors will go far in creating an optimum environment, which will benefit all homeowners. By following these guidelines and regulations and obtaining approvals for improvement to property from the ACC, homeowners will be protecting their financial investment and will help ensure that improvements to property are compatible with standards established for CPN HOA 2. If a question ever arises to the correct interpretation of any terms, phases, or language contained in these guidelines and regulations, the Board of Directors' interpretation thereof shall be final and binding.

  What documents define the rules?      
 

Every homeowner in HOA 2 should have received copies of the following documents at the time they purchased their home. It is the responsibility of each homeowner and/or tenant to become knowledgeable of this information:

The Master Declaration of Covenants and Restrictions defines overall guidelines for the entire CPN community.

HOA 2 has developed the CPN HOA 2 Regulations and Residential Improvement Guidelines, which summarizes the Master Declaration. HOA 2's Supplemental Declaration, CPN Design Guidelines, and guidelines specific to HOA 2.

Canterbury and Broadwick residents should contact the Canterbury Townhomes HOA regarding rules specific to this HOA.

     
       
  How do I get approval for my plans, or submit a complaint or questions about covenants?      
 

Canterbury and Broadwick residents should contact the Canterbury Townhomes HOA.

For all other HOA 2 residents, follow the procedures outlined in the CPN HOA 2 Regulations and Residential Improvement Guidelines.

In summary:

If you are planning to make any changes/ additions to the exterior of your home or property, you must submit a written request for approval a minimum of 30 days prior to commencement of work.

  • All requests must be submitted in writing to the following address. Complete the Request for Approval, and attach all plans including drawings, colors and materials. In most cases, a simple drawing and description will be sufficient. In the case of major improvements, such as, but not limited to, room additions, decks, structural changes or accessory building construction, detailed plans and specifications, prepared by a licensed architect, are required upon submittal.
  • The ACC may require submission of additional material and the Committee may postpone action until all required materials have been submitted. If the ACC feels additional materials are necessary or if it needs any additional information or has any suggestions for change, the application is denied for incompleteness. It will be returned to the applicant for resubmission.
  • The ACC shall approve or disapprove all plans and requests within thirty (30) days after submission. If the ACC requires an extension of time (over the 30 days) for request approval, a written agreement with the homeowner, signed by both parties to extend the time period shall be required.
  • HOA 2 review provides verification that the proposed modifications and/or improvements meet HOA 2's requirements. It does not assure compliance with the appropriate building codes or requirements of the Douglas County Building Department. The ACC/CCC committee is composed of volunteers from our neighborhood. If necessary, a particular item may be escalated to the Board of Directors, through the Board Liaision.

     
       
  What about violations, penalties, and disputes?   Questions?  
 

HOA 2 has adopted formal procedures for violations, including fines, where a homeowner does not comply with covenants or with the requirement to obtain approval for exterior improvements. (see Documents).

Covenant violation complaints must be submitted in writing to the following address. All mail must include a return name, address, and phone number. Anonymous mail will not be acknowledged or considered by the Board or the ACC.
