BOARD OF DIRECTORS MEETING
7:00 P.M. – May 20, 2004
Castle Pines North Community Center

1.  CALL TO ORDER

A.  Introductions/Roll Call/Absences

President Linda Nuzum called the May 20, 2004 meeting of the CPN Master Association Board of Directors to order at 7:08 p.m.  A quorum was established.

B.  Board Meeting Process

Nuzum explained the roles of Directors and Delegates as elected representatives of CPN-area Homeowners.  She indicated that there was a need to place time limits on all items on a full agenda in order to accomplish the meeting’s business as efficiently as possible, and to respect the time that Directors and Delegates volunteer to attending the monthly meetings. 

Nuzum made sure that everyone had a copy of the handout outlining guidelines for Homeowner input at Master Association meetings.  She invited guests who wished to speak to indicate so on the sign up sheet.  Homeowners with topics to add to the agenda should sign up for the Open Forum portion of the meeting; guests may also sign up to address a topic that is already on the agenda, and they will be recognized to speak during that agenda item.  The “Additional Homeowner Input” agenda item at the end of the meeting can be used for other questions or comments.

C.  Approval of Agenda

MOTION by Brummett to accept the agenda, moving item 10 C. Daniels Gate / Romar Maintenance Concerns to be discussed during 3. Open Forum, and accept the April 15, 2004 minutes, seconded by McDade; motion approved and carried.

2. MINUTES

A. April 15, 2004 Minutes

April 15, 2004 minutes were approved in the above motion.

3.  OPEN FORUM

Nuzum opened discussion on Daniels Gate / Romar maintenance concerns by presenting an overview of structure of Homeowners Associations within Castle Pines North.  Turquoise Terrace homeowners belong to four associations: the Castle Pines North Master Association, Daniels Gate Recreation Association, Romar HOA, and Turquoise Terrace HOA.  Jason Gibb, a homeowner recently named as the Romar Alternate Delegate, was present to listen to the concerns of the Turquoise Terrace residents.

Pat Brierley spoke on behalf of most of the residents present.  He expressed the general frustration of residents as related to the multiple HOA layers to which they belong, and the level of service from their associations.  Complaints by Turquoise Terrace residents included the lack of landscape maintenance, noxious weed issues along thorough fares in the area, and builders’ trash in the area.

Nuzum noted that the Master Association does not own or maintain any property; neighborhood HOA’s maintain open space within their neighborhood, and the CPN Metro District maintains “community” open space.  There was discussion that the landscape maintenance in question appears to be the responsibility of the Romar HOA.  Metro District Manager Dahl will research county records to confirm the land ownership and provide directional suggestions on communication avenues with the developers and managements companies. Gibb will discuss the matter with Romar HOA. 

Nuzum also noted that the Master Association can be a good resource for homeowners to network with homeowners from other neighborhood HOA’s, to explore solutions to questions about running their neighborhood HOA’s.  Turquoise Terrace homeowners obtained contact information from several of the other neighborhood representatives present at the meeting, and may contact Gibbens for additional contact information.

4.  MANAGEMENT/FINANCIAL

A.  Monthly Financial Report

The monthly financial and statistics report for April was distributed along with May payables. 

McDade reviewed the financial report for April.  She noted that as of the end of April, we had a total of 2,824 master association member homes with a total of 39 homes closing (14 new homes, 19 re-sales and 6 lots).   The Association continues to be in good financial standing.

McDade noted that as of May 12, 2004, 93% of all CPN homeowners were paid in full for association dues for 2004.  192 homes continue to owe 2004 dues and 27 homes have outstanding obligations greater than $216 for 2004.  Second notices will be sent out in the coming days.

McDade noted that we are one third of the way through the fiscal year and the budget numbers are on track.  Management fee budget numbers will even out as the year goes on with billing nearing completion.  There are specific line items where we will be over budget, including article writing, as we have no volunteers to fulfill the needs of these areas, while other line items are under budget. 

McDade also reported that she is completing work on opening of additional bank accounts at US Bank, which offers special services for HOA’s.  The Master Association will continue to hold its primary checking account at Bank West.

B. CPI Maximun Adjustment

McDade presented the board with supporting information for the annual Consumer Price Index Adjustment to the Master Association maximum dues amount.  This number does not become the new dues amount but is simply the maximum amount that the board could consider for setting dues.  Actual dues amounts are set as part of the budgeting process that will begin in November.

MOTION by Director McDade to adopt a new Maximum Annual Assessment for the year 2004 in the amount of $230.00, pursuant to section 8.4.1 of the Master Association Declaration of Castle Pines North Association, Inc.; seconded by Stopps; motioned approved and carried with a board vote of 6 in favor and 0 opposed.

C. Systems

System Security and Hosting Changes


The association is undergoing the transition to a new host for web and email services, which will provide virus and spam protection, and allow for self-management of the server.  Nuzum expects this transition to take place some time after Memorial Day.  The security consultant for the association has begum the process of analyzing the associations’ contractor systems for security and virus protection.  

Programming for Sub-Association Information and Email Alerts

Nuzum communicated the continued work being done to capture and display essential information about each of the HOA’s that each home in CPN belongs to. We will need to have staff contact each sub-association to confirm the information and establish a process for keeping the information updated.  In addition, we will develop a web program that would enable authorized sub association representatives to send emails directly to their members, while maintaining the security of the list.

Web-based Staff Calendar and Projects Listing

Nuzum presented the associations’ web-based team management program which highlights the staff calendar and displays a projects listing at a glace.

5.  COMMITTEES - COMMUNITY ACTION

A. Safety

Nuzum reported a meeting has been scheduled for tomorrow morning with representatives from Douglas County Public Works division.  Items to be addressed include traffic light timing, school zone issues and various intersections that need to be addressed.

B.  Development

No Solicitation Sign Request


Stopps received a request from the Bramble Ridge Homeowners Association asking for approval to add a “no solicitation” sign to their existing entry monument.  Stopps presented the request to the board and all agreed that the proposed signage was not the correct scale and was much too large.  This request will be returned to the sub association for modification.

Stopps recognizes the need for a standard to “No Solicitation” sign requests.  He suggested that the standard size should be small and of the same size and design as the no solicitation sign that the Glen Oaks neighborhood displayed.  Placement of the sign should be on one of the outside existing pillars.  Approval of all non solicitation sign requests for entry monuments will still need to be made by the Master Association DRC and should be submitted at least 30 days in advance.

MOTION by Thompson to approve the standard no solicitation sign size and placement as presented above; seconded by McDade; motion approved and carried.

Nuzum noted that the “No Soliciting” topic was discussed at last month’s county-wide HOA forum, with the Sheriff’s department advising that neighborhood “No Soliciting” signs do not have any legal impact, and that the best solution is to report any solicitor who does not have the required soliciting permit.  Details will be outlined in the next Connection newsletter. 

6. COMMITTEES-MASTER ASSOCIATION

A. Communication.

Nuzum reported that the communication team has been very busy with community emails being sent, publication of the newsletter currently in process and website updates continuing to be made.  For April the website had approximately 241 visitors daily.

B. Social

Nuzum reported Social Committee Chair Kenny is very busy with the Community Wide Garage Sale which starts tomorrow.  She announced that we have over 200 homes listed on the website who will be participating in this event over the weekend.

No update was available for the Octoberfest date.

7.  PARKS AUTHORITY

Nuzum reported that the Authority plans on breaking ground this fall for the new park to be located north of the intersection of Castle Pines Parkway and Lagae.

 8.  METRO DISTRICT UPDATE

Nuzum reported for McDade that the drilling of the well located off of Hidden Point Blvd. and in Coyote Ridge Parks is complete.  Work will continue at the site, preparing the well for use. The next Metro District Community meeting is scheduled for next month, June 21st, and all residents are encouraged to attend.

9.  OLD BUSINESS

A. Hidden Pointe Relationship

Nuzum reported there has been no response from the Hidden Pointe HOA board with regard to mediation of the lawsuit.  The Association’s attorney will move forward with bringing the CPN Metro District and Parks Authority into the lawsuit, and naming potential witnesses for the case.

Past representative, Rita Coltrane, notified the CPN Board that she has been released of her duties as Hidden Pointe’s Delegate to the CPN Master Association.  Hidden Pointe residents who have questions as related to the Master Association should contact the association at 303-482-3078 or email admin@cpnhoa.org.

B. Pet Policies

Gibbens reported that Gilbert plans to constitute the Pet Policies Team this summer noting that the new “one bite rule” needs to be reviewed and discussions with Douglas County Animal Control and Denver Dumb Friends need to be scheduled.

C.  Xcel Power Line Rebuild

Nuzum reported that the Colorado state legislature approved Xcel’s noise nuisance bill. The approved bill is a significant improvement over the original bill.  While our Committee continued to have concerns about the bill, the Colorado Municipal League supported the amended version, and believed that concerns about the bill could be addressed when the PUC takes their actions to set noise standards on future utility right of ways, easements and upgrades. 

D. HOA Forums

Castle Pines North Landscape Maintenance Workshop, 4/26


Gibbens reported the sub association landscaping collaborative meeting was canceled due to lack of participation.  District Manage Dahl is in the planning process for a district meeting with all of the sub HOA managers and landscapers to go over and answer any questions that might stem from the new water budget plan and watering restrictions for 2004.  Gibbens will get with Dahl to verify this meeting and field future interest of this meeting topic.

Douglas County Homeowners Association Forum

Nuzum reported the Douglas County Homeowners Association Forum was well attended by a combination of association representatives, managers and county representatives.  Areas covered included, public and traffic safety, future development, no solicitation issues, neighborhood communication and covenants.  Based on the success of this meeting, the group was interested in holding additional meetings in the future.  The Highlands Ranch Community Association will provide administrative support for organizing the meetings.

10.  NEW BUSINESS

A. Air Traffic Committee Update

Shul reported that she attended the May 11th Citizens Advisory Committee Meeting at Centennial Airport where noise reports and complaints for March, April and year-to–date were presented.  In the numbers reported, it was apparent that a small number of households (5) were attributing for a large percentage (74%) of the complaints.  The main complaint areas came from SW Lone Tree and the NW area which includes Greenwood Village.

The Part 150 Study, containing recommendations regarding the noise situation, has been before the FAA since August of 2003.  When the 180-day public input period is set, Shul suggests that information be distributed via e-mails alerts, website and the Connection as to how CPN citizens can have input into the FAA decision.

In the meantime, citizens can call in noise complaints to the Centennial Airport Noise Complaint Line at 303-790-4709.

As for low flying aircraft, those complaints can be called into Centennial Airport any time.  Aircraft are required to fly no lower than 1000 feet.  If planes are so low you can read the ‘N’ number on the aircraft, that would be all that is needed in order to issue that aircraft a violation.

B. 2004 Elections

Shul noted that Fire Issue A passed the South Metro Fire Rescue District vote.  At the request of a citizens group, a caveat was added through a resolution to the issue indicating the Board of Directors of the South Metro Fire Rescue District would evaluate their budgeting of Issue A funds and make future refunding recommendations if they were called for.  For complete details visit the South Metro Fire Rescue website, www.southmetro.org.

Nuzum reported that approximately 9% of CPN voters took part in the May 4th election with Cheryl McDade, Mark Shively and Courtney Brand winning seats on the Castle Pines North Metro District Board.

County commissioner seats are also up for election in November.  The Primary election to select each party’s candidate will be held on August 10.  Republicans have placed one candidate Primary Election ballot, and other candidates may petition to be included in the Primary.  CPN resident Doug Gilbert is running under the Democratic ticket and is the southern most candidate currently running.  Nuzum also reported that a group is passing petitions to have voters decide if Douglas County should increase the number of county commissioner seats from three to five. 

Nuzum also reported that the November election will bring changes in our representation in the State Legislature.  Our current State Senator, Ken Clouber, will step down due to term limits.  Our current State Representative, Tom Weins, is running for the Senate seat.  Current County Commissioner Jim Sullivan is a candidate for the State Representative position.  There will also be Democratic candidates for both of these positions on the November ballot. 

The Master Association encourages all residents to keep themselves informed about this years’ election and please vote at your local polls.

D.  Signage

Nuzum reported that there has become a proliferation of signage within the CPN area.  With the removal of the permanent green builder sings, the smaller “weekend” builder sign have become more of a problem along with realtor signage.  McDade and Gibbens started the project of writing CPN Sign Guidelines.  Brummett requested that they report at next month’s meeting.  With the development of the guidelines, comes the need for an enforcement structure.  The association would need to engage an additional contractor for implementation and enforcement of these guidelines and budgeting would need to be established for next year.
