This 2006 bill was introduced to clean up 2005's SB100.
Current Status: The bill, SB06-089, has been signed into Law. This law modifies CCIOA (Colorado Common Interest Ownership Act). SB06-89 modifies the HOA operations and policy requirements made by SB05-100 in 2005.
Portions of the law which went into effect when the law was established (June 2005) including: guidelines for HOA regulations related to Xeriscaping; displaying of flags and political signs; and, fire protection measures including roofing materials and approval of homeownersx plans for defensible fire space.
More complex provisions, which took effect January 1, 2006, require all HOAs to assess and possibly modify their operating procedures. The new law also requires: disclosures and communication with current and prospective homeowners; policies for HOA operations; and procedures for managing covenant enforcement and architectural plan approvals.
Compliance with SB100 requires the Association to keep and make available records, adopt policies and communicate with homeowners. Many of the law's requirements were met by the existing practices of the Association. Several specific requirements have been met through adopting policies and making information available to homeowners.
Policies: Both SB100 and SB89 require HOAs to adopt a set of operations policies. The adopted policies are available on the Master Documents and Policies page.
Disclosures: A specific list of information is required to be disclosured to homeowners. Much of this information was already available through the website, the Master's Disclosures page groups together a directory of the disclosures.

Each HOA in CPN is responsible for its own implementation of SB100.
In June 2005, the CPN Master Association Board established a task force to coordinate both the Master's SB100 Compliance efforts and provide a collaboration forum for CPN HOAs working on their own implementations. Membership includes Master Association and sub Association representatives.
There are two versions of the policies: The generic policies were drafted by our attorney and are not customized to the Master's documents. The Master Association worked with the attorney to customize the policies to our governing documents and the inputs of the Master Board. These customized polices were presented to the Board in November 2005 and were adopted in December. The Master Adopted Policies are available for review along with the Master's governing documents.
CPN HOAs using the Master's Policies - CPN Boards wishing to use the policies for their own SB100 Compliance are advised to start with the generic policies, and then incorporate changes required by the HOA's documents. SB100 ammends sections of CCIOA. The Provisions in SB100 apply to all Colorado Homewoner's Associations (except some time-share situations). The SB100 section numbers refer to CCIOA sections which will be rewritten to contain the SB100 requirements.

CCIOA, first passed in 1992, established requirements for HOA governance. Some HOAs were formed before CCIOA (Pre-CCIOA Associations) and chose to opt-out of CCIOA compliance. Regardless of an HOA's incorporation date, however, all SB100 provisions apply.
